There is nothing more difficult than losing a loved one; when that loss occurs suddenly, families find themselves struggling to come to terms with the emotional pain and financial burden they suddenly face.
At the Chris Mayo Law Firm, we believe that you should not have to simply deal with the immense challenges of losing a loved one due to someone else’s negligence on your own. Whether it was a car or motorcycle accident, truck collision, defective product, or act of medical malpractice, when your loved one’s death was caused by another party’s negligent or wrongful actions, you have the right to a fair recovery. Our San Antonio wrongful death attorney can help you understand your legal rights and options. We understand that nothing can undo the pain of losing your loved one; however, a fair recovery can allow you the ability to navigate your new financial reality and achieve a sense of justice on behalf of your loved one.

What Makes a Death “Wrongful?”
While some accidents are truly that, accidents, others could have and should have been avoided. When a fatal accident or incident occurs due to the negligent or wrongful actions of another person, company, manufacturer, or some other party, that death is considered “wrongful.”
The surviving family members and dependents of someone who is wrongfully killed are entitled to receive financial compensation for their damages. In order to bring a claim, you generally will need to show that, had the victim lived, he or she would have had grounds for a personal injury claim. In other words, you must show that another party acted negligently/wrongfully and that this led to your loved one’s death.
Some common causes of wrongful death include:
- Car accidents
- Motorcycle accidents
- Truck accidents
- Medical malpractice
- Nursing home abuse
- Dangerous premises
- Slip and fall accidents
- Dog bites
- Defective products
- Oil rig accidents
- Workplace accidents
This list is not exhaustive; any accident or incident can lead to wrongful death if it resulted from someone else’s negligence.
Compensation in Wrongful Death Claims
The term “compensation” is a bit of a misnomer when it comes to wrongful death claims; nothing can ever “compensate” for the loss of your loved one. In fact, financial recovery is not meant to negate what happened but rather to assist grieving individuals and families in the healing process.
Every case is different and, therefore, the compensation you may be entitled to receive will vary. However, in most wrongful death cases, the following damages are available:
- Medical costs for treatment needed prior to death
- Funeral and/or burial expenses
- Loss of income/wages
- Loss of expected future earnings and/or inheritance
- Loss of support (financial, emotional, and otherwise)
- Loss of consortium
In rare circumstances, you may be able to recover punitive damages, which are meant to punish liable parties for egregious negligence and prevent future accidents from happening.
