Trinity Health, hepatitis C outbreak victims come to a settlement

 In Premises Liability

Not-for-profit Catholic health care company Trinity Health and its hospital in Minot, North Dakota-based have reached a settlement with 21 victims of the largest hepatitis C outbreak in recent history in the United States. However, Trinity’s legal battle with Toledo, Ohio-based skilled nursing care facilities company HCR Manor Care, where most people got the illness, will continue.

Attorneys for Trinity filed a request with Judge Todd Cresap to dismiss the lawsuit filed by the nursing home, saying that they had already reached a confidential settlement with the victims themselves. They requested for Cresap to allow a connected legal dispute between the hospital and the former Manor Care to be resolved in federal court. Cresap has yet to make a decision on the case.

Behdad Sadeghi, the plaintiff’s legal counsel, said in an interview with The Associated Press that the settlement amount still needs to be finalized, but that an agreement had been reached in principle.
